How hard is it to get disability benefits in Colorado?It can be very difficult to win disability under either Social Security Disability or SSI in any state, including Colorado, due to the nature of the federal disability system. The system, for many decades, has been one that usually results in long wait times at the disability application level, as well as long wait times for the scheduling of a disability hearing before a federal administrative law judge, or ALJ. The system is also one that typically results in fairly high rates of denial in practically every state. This tends to be because disability examiners have an institutional bias that leans toward denying most claims, and this bias is most evident when we see how cases eventually get approved at disability hearings that occur long after the initial claim has been denied. Because most claims will be initially denied on the disability application, but yet a substantial percentage will be approved following a hearing appeal, claimants who are either in the system, or entering the system with a new claim should brace themselves for long waits and the likelihood of an initial denial, but keep in mind that they should not give up on their claim. It is especially true in the SSD and SSI system that persistence is often the key to a favorable outcome. And, in fact, many have the opinion that SSA denies claims at a high rate initially simply to discourage applicants from pursuing their claim further. If you get denied for disability in Colorado or any other state, file your appeal asap, and consider getting representation to increase your chances of approval.
