Is there a way my lawyer can get my disability court date faster?
In most cases, probably not. It used to be that a person could ask for an expedited hearing based on dire need. And that's still possible, but hearings offices probably get a lot more dire need requests these days.
Sometimes, however, contacting a congressman can help to speed up a hearing. Finally, if a person's condition has gotten significantly worse it may be possible that their most recent records clearly establish that they meet the definition of disability used by SSA and demonstrate that they should be approved on the basis of a listing or through a medical vocational allowance.
If that's true, then the individual's attorney might wish to request an on the record review which would eliminate the need for holding an actual hearing. Which obviously saves a lot of time. However, to get an on-the-record review and hopefully get one's case approved without the need for a hearing, the records would have to clearly point out that either A) the case should have been approved in the first place and was mistakenly not or B) quite a bit has changed medically since the last denial.
